20200401A-IN-CORR-ball01 - SYSTEM & MORAL CORRUPTION INCIDENT

SUMMARY OF INCIDENT: Mr Ball used deception to avoid accountability for the negligent actions of his department.

BACKGROUND: Ms Lake indicated in an email that the placing of the notice in private property was a civil matter indicating that the planning department had broken protocol in placing the notice on private property but it was not a criminal matter.  

ACTION: Mr Ball wrote in an email " I acknowledge, however, that you have since advised that the pole is in your property. I do not however consider this to be illegal"

PURPOSE OF THE ACTION: By using the word illegal in italics he is indicating that he is using the word literally and by doing so he has attempted to avoid accountability for the negligent actions of his department, a member of which had placed a planning notice on private property. TYPE OF CORRUPTION: SYSTEM - The purpose of this action breaches the NPTC staff code of conduct which states: 

The public is entitled to expect the highest standards of conduct from all employees of Neath Port Talbot County Borough Council. The role of such employees is to serve the Authority in providing advice, implementing its policies, and delivering services to the local community. In performing their duties, they must act with integrity, honesty, impartiality and objectivity.

TYPE OF CORRUPTION: MORAL - The purpose of this action breaches the NPTC values as stated in the Corporate Plan

We will conduct the work of the Council in an open and accessible way, ensuring we are properly accountable for the decisions we make.

SUMMARY OF INCIDENT: Mr Ball used deception to avoid accountability for the negligent actions of his department who placed a planning notice on private property.

ACTION: Mr Ball wrote in an email: "I responded to one myself yesterday about the site notice on a telegraph pole on your property, to which you have sent a further response and question.

PURPOSE OF THE ACTION: Mr Ball has referred to a question that he has not answered. Mr Ball is aware of a breach of protocol relating to the placement of planning notices on private property. By not answering the question Mr Ball is attempting to avoid accountability for the negligent actions of his department a member of which had placed a planning notice on private property. This is the first in a series of REFERENCE AVOID DECEPTION INCIDENTS conducted by Mr Ball relating to this planning application.

In this video, we see how the Neath Port-Talbot Council Planning Development Manager Steve Ball has grossly misrepresented the role of Natural Resources Wales in the planning process for the Heol y Glyn development. This is evidence he is presenting as factual to the Planning Committee. We believe that the reason he does this is to cover up Planning Department malpractice which allowed the Cuddy Group to tip on the site unregulated and to provide the Planning Committee with a sense of lawfulness for the development and in particular the illegal tipping habits of the Cuddy Group. The Cuddy Group were tipping at the Heol y Glyn site from 2005 to 2016  while Natural Resources Wales was founded in 2013 and the Cuddy Group's first NRW licence dates from August 2014 by which time the majority of tipped material had been brought onto the site.

This video shows how the Neath Port Talbot Council breached the 1990 Environmental Protection Act and placed the health and lives of the residents of the following Glynneath streets at risk from untreated contaminated land:

Waun Gron,  Brynhyfryd, Woodland Park, & Heol y Glyn and Inter Valley Road (A4109).
